Will I have an Issue Travelling? --> Legal Advice

Post Fri Mar 12, 2010 9:03 am

Hello, I have no clue whether or not I am in trouble when it comes to travelling. I don't know if I have an arrest record or a criminal record, if i will be able to clear a background check or anything, including travel!!

In August 2009, I was caught shoplifting from The Bay. Loss Prevention took me, and the police then came. They rifled through my belonging, taking down all the information they could, including my car insurance slip. They told me they were not going to charge me criminally, and continued to give me a lecture (21 years old, clean record and finishing university). I got no fingerprints, no slip to take me to court, no police station. They handed me over a $70 ticket for trespassing and told me to pay it within 15 days. They left telling me not to get into any more trouble. I paid the ticket online.

Now, after countless hours of researching online the possible outcomes of my situation, I am still confused as to whether or not I am in trouble regarding my record. Some websites are saying that I have a criminal record, or that I will have trouble travelling, and others say that I have nothing to worry about. I'm in so much worry, this is all I think about, and I would love some clarification on my issue. I have not told a soul about this incident and no nothing about law which makes it even harder to go about this (getting a record check etc.)

Therefore, what does my record look like? Is the "arrest", the situation or the ticket on my record? Will I have any issues travelling? Some people say that an arrest can prevent you from travelling. Please help as I am in desperate need.

Thank you in advance,

All Loss Prevention is is security guards, which dont have any more power than the average joe. You cannot get a criminal record without a criminal conviction by a judge in a court of law. If you were not arrested and processed (fingerprints, photos, etc.) then nothingwould show as an arrest. In fact, I would recommend looking further into the situation you described, as it would be illegal for loss prevention to issue you a fine, as it sounds like it is offered in lieu of calling the cops, which would be extortion, and highly criminal. As long as it is like you said, no judge no cops, you will have no issues crossing the border, i would recommend amnesia of the event, why bother bringing up something which according to your record never happened.

The police did come, they were the ones who issues me the trespassing ticket, which to my knowledge is the same as a speeding ticket. My question is that given my situation, and the provincial offence ticket, will I be able to travel??? Thanks

Traveling to US for the first time on a personal trip...i had the H1 Visa valid for six months and all the legal documents..apart what are the some special documents required while to enter in US..

Keeping in mind the recent strict regulations..by the immigrating authorities..don't want to put myself in trouble..

Thanks:

Dear Friends,

I am in a similar situation. I had to leave my PhD program in US under some extremely unfortunate conditions. My advisor got really angry on me and took vengeance on me by making the false claim that I had not returned his laptop and books. Later I received threatening emails from the HOD and the police officer on campus that if pursued criminally, I could be charged on felony. I replied back saying the charges made were false. I did not hear back from them at all. I need to know if there are some charges against me. Please advise if there's some way to check this.

Now I have to go urgently to US to meet my close relatives. Please help.

Thanks,
Ulyssesdreams.
