Will Overstayed Visit Affect K-1 Application/Approval????

Hi everyone!

I'm having a bit of an issue...

I just added up the days that I spent in the US for 2008 and now realized that I exceeded the 182 days (by 14 days) that a Canadian is allowed based on the tourist visa waiver program. This was not my intention, I unfortunately miscalculated and forgot about a 10-day visit I took before making my last visit.

I just want to find out if this will negatively affect the process and/or approval of our K-1 :(

Canadians are not part of the visa waiver program, we are a tourist entity entirely different, classified basically just as "Canadian visitor".

It likely will not be much of a problem, AFAIK, unless you're still in the US now for some reason waiting out your K1 interview. If you're in Canada, and you left the US under your own steam (rather that deported) it is unlikely that they'll pay too much attention to exactly how many days you spent in the US this year.

When is your K1 interview? Or have you even started the process yet?

We haven't processed the K1 yet (almost finished the package). And I'm currently in Canada.

Quick question: At the interview do they ask if you have ever overstayed? Or how many times you visited and what were the durations?

Oh and I have visited Visa Journey thanks to you posting it in every thread, lol. That site has helped us tremendously with getting our package together!

Also, btw... what does AFAIK mean :?

AFAIK = as far as I know.

Yes, before you go for your interview they will send you a package of forms that you will need to complete. On one form you will need to list ALL the dates and durations of your visits to the US since the beginning of time. I can't remember which form it was, (its a DS form) but there are example forms posted at VJ that you can have a look at. Maybe poke around the K1 forum there as well, and/or the Canada forum. I had my interview more than 4 years ago, and I've slept since then ;) They're the immigration forum, we're technically the traveller forum.
