Hello there,

My spouse recently started working in US on a TN visa. I work as a Business Consultant in Canada for a Canadian company and have Canadian clients, I get paid in Canada as well. Because of the nature of my job I have the flexibility to work from home when i am not at the client's site. My question: Is it okay to work from my home in US (where my spouse lives) for a Canadian company? My understanding is that once i move to US I will be considered on a TD status - under which i can't work in US. Can someone please give me some suggestions.

thanks

They'll make your life very difficult if you do that commute, and eventually you'll be denied entry to the US unless you have some sort of visa that allows you to stay and work.

I'm not exactly sure how the TD works though, is it automatically derrivative, or do you actually have to go and apply for it, along when your spouse applies for the TN and then they stamp it in your passport?

Thanks Reba,

I don't think i can automatically receive a TD status, I have to show them the I-94 for my spouse and our marriage certificate to get it as i am also a Canadian citizen. I know that i will be coming to Canada every 3-4 weeks at the minimum. Not sure what the right thing to do would be!

Perhaps someone at TN visa Expert would be of more help.
