Worried about a 10 year ban

I have lived in the USA for 10 years as of this august. I am an Canadian citizen and was waved through at a point of entry when my parents and I moved here when I was 12. I have graduated high school and college here and am Dream Act eligible if it ever passes. But I don't think its going to pass and I'm trying to decide to move back to Canada to move on with my life. However I am worried about the 10 year ban. I would like to come back for visits and see my friends and go to vegas, etc. I have read that because I was waved through and do not have an I-94 or any other type of visa, that because I am Canadian and have not overstayed a visa that the 10 year ban would not be applicable unless I get stopped by ICE. On top of this issue how would/what would be the best way to get back to Canada. My plan was to fly to New York and have my uncle pick me up and drive across. What type of questions would they ask? Would the Canadian officials care that I overstayed in the US? Also considering I would have to get a new passport at I'm assuming the Canadian consulate here it would be the first time they scanned it going back in. Would that cause any red flags either at the consulate or at the border? Would the consulate say anything to immigration?

Sorry for all the questions all at once.

You will only be penalized if you stayed in the USA past you 18th birthday. It is you parents doing that you were here prior to you being 18, anything after 18 is on you. Dream Act, Obamas attempt to get voters to re-elect him, what a joke. Go to Canada first and foremost. I doubt you will have problems seen as it all stemed from your parents and you were under age.

THE DREAM ACT IS NOT A JOKE. CHILDREN DON'T ASK TO STAY IN A COUNTRY ILLEGALLY! ALL POLITICS ASIDE, IT IS NOT THE FAULT OF THOSE KIDS WHO ARE IN THE US UNDOCUMENTED BECAUSE OF THE FOOLISH DECISION BY THEIR PARENTS TO OVERSTAY!

I have worked in academia with many young children looking for a bright future in nursing, science, mathematics, music, writing and the list goes on..... They find out their dreams in the US are shattered because they have NO PAPERWORK stating they are legally entitled to live and work in the U.S. I have had kids who willingly went back home and try to come back with student visas only to be turned back at the border. They would call me at work devastated.

So you really hit a nerve in saying the Dream Act is a Joke LAWS...Usually I agree with you when people knowingly try and wiggle their way to the U.S. illegally. I'm not for that..

The Dream Act IS a joke. It is was not thought up to help these kids. It was only thought up to get the Hispanic votes. Everything is politics. Sorry, but true.

To clarify, I am not saying that I disagree with the idea of the Dream Act, I only think it is a joke because it is being used as an election tool and not for the actual children.

Ok I agree that, that portion of it is all politics. But seriously, there needs to be some sort of forgiveness program instilled specifically for undocumented children under 18. It's just not fair to them, that's all I'm saying.

I guess I'm one of the "minority" few that feel Obama is really trying to fix things for the betterment of the US and its economy. The media has overshadowed people and BRAINWASHED them with this BS about his "inability" to run a country. So much disrespect thrown at him from all over its unreal. But this is not a political forum so I will end here... hehe.

I hope our poster can eventually get his stuff together with his legal status. Best of luck to him!

Nope. Because then we will have another "Bush" era by a *cough* *cough* repub *achoooo*.......And we wouldn't want that now would we?
