I have lived in the USA for 10 years as of this august. I am an Canadian citizen and was waved through at a point of entry when my parents and I moved here when I was 12. I have graduated high school and college here and am Dream Act eligible if it ever passes. But I don't think its going to pass and I'm trying to decide to move back to Canada to move on with my life. However I am worried about the 10 year ban. I would like to come back for visits and see my friends and go to vegas, etc. I have read that because I was waved through and do not have an I-94 or any other type of visa, that because I am Canadian and have not overstayed a visa that the 10 year ban would not be applicable unless I get stopped by ICE. On top of this issue how would/what would be the best way to get back to Canada. My plan was to fly to New York and have my uncle pick me up and drive across. What type of questions would they ask? Would the Canadian officials care that I overstayed in the US? Also considering I would have to get a new passport at I'm assuming the Canadian consulate here it would be the first time they scanned it going back in. Would that cause any red flags either at the consulate or at the border? Would the consulate say anything to immigration?
