Writing in the USA

I'm looking at some job opportunities in the USA and while I don't expect having problems getting sponsored for a TN visa, I'm worried about my girlfriend.

She has decided to take some time off of school (she's a year short of finishing her degree) to focus more on her writing. She has completed a novel already and is working on a second and starting to look for agents/publishers.

My question is, can she write legally in the states? I assume that she can go on a B-1/B-2 and write but if she were to be taken on by a US agent or publisher while down there I assume that would be illegal? If she was being published by a Canadian would she be able to write in the US?

What options does she have for writing in the US?

Nearly 100% of the time, an uncompleted degree or education translates into simply one thing, no TN-1 sponsorship. A degree is a mandatory prerequisite in obtaining a TN.

One option for writing under TN would be the Technical Writer category, which requires a Bachelor’s degree in the field or a 2-year post secondary diploma, and 3 years work experience as a Writer.

Since she lacks the degree, the degree requirement disqualifies her. If she can transfer her university credits to a college and get a diploma that may work if she can present 3 years work experience.

An H1B specialty occupation might also be a possibility in which a Bachelor's degree can be presented but the work authorization would not be instantaneous as it is for TN-1 at the U.S. Border.
