Yet Another Dual Status Question - Canadian return

Postby lnishika » Tue Mar 09, 2010 11:44 am

This is a basic question but I can't seem to find a clear answer.

I filed in the US as dual status in 2008. Here are all the details in case it makes a difference:
- Canadian resident under Tax Treaty on F1 status until June 27 2008
- US resident for tax purposes until from June 28 2008 - TN status
- physically present in 355 days present with no "residential ties" to Canada during that time
- staying in US until 2012 (end of TN status)
- no Canadian source income all year (but tuition I'd like to roll over)
- no Canadian permanent address
- Quebec resident prior to 2008

What status am I in Canada for 2008?
- resident
- non-resident
- deemed non-resident
- deemed resident

Thanks!!

You should have filed a "departure" return in 2008 for canada (and quebec), fulfilling all the requirments fouind the ibn CRS'a emigrant guide. You departure date would be June28, when you stopped F1 status.

For 2009, you would file nothing in canada.
