YMS to Tier 2!

Hey!

As most people on this board, I have been stressing out about this for a long long time now.

YMS to TIER 2 - How will this work in practise?

My situation: YMS expired in December 20.
Currently employed with a reputable Insurer. Have not spoken to HR, but I am quite sure they will sponsor me. Last time I checked I met all the education and remuneration requirements.

Now the devil in the details!

Q1. How long do I have to leave UK to return on a Visitor visa?
My YMS expired Dec 20th. So I was planning to go somewhere near by (outside Schengen Zone) for sometime. How long do I have to be away to come back on a Visitor Visa? (No home in Canada to return to)

Q2. Does the company have to end my employment and then do I have to go through the recruitment process OR could I go on a 'garden leave'?

Q3. For Tier 2, the Employer has to advertise my position for 1 month. How does this work? Can they advertise Nov 20 to Dec 20, and start processing my application right away?

Q4. Do I have to apply from ABROAD or can I apply on a Visitor visa from inside the UK? Can I apply from say Poland instead of Canada, or will I need 'Must apply from there where you have a Visa to stay'? I recall YMS had that restriction.

Q5. Will a 'permanent address' come up in this process as I no longer have one? Been trotting the world for too long.

Q6. Will my company even be able to sponsor me? How is the new Tier 2 Sponsorship scheme coming along? Any luck?

1) You can't actually apply from a country in which you are only a visitor, you'll have to apply from Canada, but the good news is you can apply as soon as you go back.

2) Your employer will have to end your employment and go through the recruitment process as they have to pass the "Resident Labour Market Test" if your job is not on the shortage occupation list. You can find this list on UKBA website (www.ukba.homeoffice.gov.uk).

3) They can issue you a certificate of sponsorship as soon as the RLMT has been passed. They should know how to process as they've already done that in the past.

4)See answer 1.

5) Where does your important post go? You should put that address as a permanent residence address.

6) If they are registered as sponsors and follow the requirements and codes of practice, they should succeed in issuing you a certificate of sposorship, which you'll need to complete your application.
